Terms & Conditions

These Terms & Conditions (“Agreement”) govern all rentals and services provided by Party All Day Rentals (“Company,” “we,” or “us”). By reserving or using any rental item, the customer (“Renter,” “you,” or “your”) agrees to the following terms:

1. Reservations / Deposits

  • To get on our calendar, a 50% deposit is due when you submit your reservation.
  • The deposit is non-refundable but does apply to your total reservation amount.
  • Your reservation is not complete until your deposit has been paid.
  • Reservations are not guaranteed until the deposit and signed agreement are received.
  • The remaining balance is due 7 days prior to the Event Beginning Date, unless otherwise approved in writing.
  • Payments can be made with Venmo or Credit/Debit Card.

2. Sales Tax

  • All rental items, services, and applicable fees are subject to Utah state and local sales tax as required by law. Sales tax will be calculated based on the delivery or event location and will be added to the total invoice at the time of booking or final payment.
  • Sales tax rates are determined by the taxing jurisdiction in effect on the date of service and may change without notice. The customer is responsible for payment of all applicable taxes. Any tax exemption must be disclosed at the time of booking and supported with valid documentation prior to payment.
  • Failure to provide proper tax-exempt documentation will result in sales tax being charged at the applicable rate.

3. Rental Period

  • Rental periods are on a per day basis (if other arrangements are needed please contact us)
  • Timely return of all rented property is required to ensure availability for subsequent rentals. Failure to return items by the scheduled return time may constitute a breach of this agreement and result in additional fees.

4. Delivery / Pickup

  • Items can be picked up from our location:
    • 9891 N 4100 W, Cedar Hills, UT 84062
  • A pickup and return dropoff time will need to be coordinated ahead of time to ensure your items are ready for pickup.
  • Requested pickup and dropoff times are NOT guaranteed and are subject to change
  • Our delivery/pickup is curbside, and that does not include setup or takedown of the chairs or tables. The chairs will be on carts, and they will need to be stacked back on the carts close to where we can come to pick them up.
  • For items such as our arches, large marquee letters, dunk tanks, foam machine, dance floor, tents and more are set up and taken down by our team within a reasonalbe distance from the delivery vehicle.
  • Extra fees may apply for stairs, long carry distances, or difficult access locations.
  • Reservations of our tent(s) does include setup and takedown, but does not include delivery.
  • Delivery fees can be found on the reservation form and are subject to change
  • Please include your expected delivery and pickup dates and times in your reservation form submission,
  • Requested delivery and pickup times are NOT guaranteed and are subject to change
  • We will reach out the week of your event to discuss the specifics on time of delivery and pickup.
  • Rental items must be ready for pickup in the same condition and location as delivered, unless teardown service is included in your order.
  • We try to accomodate your requested delivery and pickup times, however we cannot guarantee the requested specific times. We do need to coordinate your reservation with other reservations that we have to deliver and pickup.
  • **Sunday deliveries/pickups require an additional $100 on top of your delivery fee. To avoid this fee, coordinate with us on a delivery and pickup time before and after a Sunday.
  • Holiday deliveries/pickups require an additional $100 on top of the delivery fee. To avoid this fee, coordinate with us on a delivery and pickup time before and after the holiday. This might not be possible however due to our schedule and product availibility. The holidays that require the additional fee are listed below:
    • New Year’s Eve and New Year’s Day
    • Valentine’s Day
    • Easter
    • Memorial Day Weekend (Saturday to Monday)
    • Independence Day (July 4th)
    • Labor Day Weekend (Saturday to Monday)
    • Halloween
    • Thanksgiving Day
    • Christmas Eve and Christmas Day

5. Cancellations

  • Reservation deposits ensure we keep the requested items available for your event. Unfortunately we cannot refund deposits as we have most likely told other clients those items are not available, and have missed out on renting to someone else.
  • Deposits will not be refunded at all.
  • If a reservation is cancelled before the 7 day payment deadline, and a full payment has already been made, a 50% refund will be given.
  • Your remaining balance is is due 7 days before your event. Cancellations within 7 days of the reservation date will not be refunded.
  • Party All Day Rentals is not responsible for delays caused by weather. Party All Day Rentals reserves the right to cancel outdoor set ups including but not limited to tents when affected by weather and other causes beyond Party All Day Rentals’ control. This includes acts of God, war, civil disorder, fire, communicable diseases, other emergencies or crisis including both named and unnamed storms, windstorms and hurricanes, which would prohibit the safe set up and usage of such items and/or inhibit delivery. Due to insurance regulations and safety requirements, this decision is to be made only by Party All Day Rentals, and includes the right to strike existing setups. 
  • No refunds are issued for weather-related cancellations once items have been delivered or set up.

6. Damage, Loss, or Theft

  • The Renter assumes full responsibility for the rented items from delivery until pickup.
  • If any of our rental items are damaged, lost, broken or stolen, a damage or replacement fee will be charged. 
  • Inspection of rental items will be conducted upon return.
  • The damage fee may cover replacement of item(s) and/or time to fix or replace the item(s)
  • A valid payment method must be on file to cover any additional charges.

7. Liabilty & Risk

  • Renter agrees to assume all risks associated with the use of rental equipment.
  • Party All Day Rentals is not liable for injury, loss, or damage arising from use or misuse of rental items.
  • Renter agrees to supervise all rented items during use, especially inflatables, games, and equipment used by children.

8. Chair Rentals

  • Chairs cannot be used as a stepstool or ladder for any purposes
  • All rented chairs must be returned in clean condition, free from excessive dirt, mud, or staining due to spills or other causes. A cleaning fee of $50 will be assessed for any chair rentals returned in a condition requiring additional cleaning beyond normal use.
  • Chair rentals DO NOT come with setup or takedown. Please reach out to us for a custom quote for setup and takedown of chairs. 
  • Chairs must not be left in areas where they may be exposed to water from sprinklers, irrigation systems, or other sources. While unforeseen weather conditions such as rain are understood, lessee remains responsible for taking reasonable precautions to protect rented items from water damage.
  • Party All Day Rentals is not liable for any injuries or damages resulting from the use or misuse of chair rentals.

9. Tent Rentals

  • For the safety of our customers and the integrity of our equipment, all frame and high peak tents are installed and removed exclusively by Party All Day Rentals. Popup tents are the only exception and may be customer installed unless setup service is purchased.
  • Our installation crews are professionally trained, experienced, and fully insured. We use commercial-grade equipment and follow industry best practices and safety standards to ensure your tent is installed correctly and securely.
  • The customer is responsible for ensuring the installation area is accessible, level, and free of vehicles, trailers, furniture, debris, or other obstacles before our crew arrives.
  • The installation area must provide sufficient clearance for equipment and installation personnel. Additional labor charges may apply if our crew is delayed due to site conditions or lack of access.
  • The customer is solely responsible for locating and identifying all underground utilities, sprinkler systems, septic systems, drainage lines, invisible fencing, private electrical lines, gas lines, water lines, fiber optic lines, and any other underground hazards.
  • Before installation, the customer must:
    • Contact Blue Stakes/811 to have all public utility lines properly marked.
    • Clearly mark or flag all private sprinkler heads, sprinkler lines, irrigation components, septic systems, and other underground improvements that are not marked by 811.
  • Party All Day Rentals relies on the information provided by the customer and utility locating services. We are not responsible for damage to underground utilities, sprinkler systems, irrigation lines, landscaping, sod, grass, concrete, asphalt, driveways, patios, or other property resulting from normal tent installation or staking when these items were not properly identified or cannot reasonably be detected.
  • Tent installations require driving stakes into the ground or using approved ballast systems depending on site conditions. While every reasonable precaution is taken during installation and removal, Party All Day Rentals is not responsible for damage to grass, landscaping, sprinkler systems, underground utilities, irrigation components, or other property that may occur during normal installation or removal of the tent.
  • The customer assumes responsibility for ensuring the installation location is suitable and free of underground hazards.
  • Our tents are commercial-grade structures designed to perform well in normal weather conditions when properly installed. However, tents are not hurricane, tornado, or severe storm shelters.
  • In the event of:
    • High winds
    • Thunderstorms
    • Lightning
    • Severe weather
    • Tornado warnings
    • Any dangerous weather conditions
  • Guests should immediately evacuate the tent and seek shelter inside a permanent building or other appropriate structure. Do not remain inside the tent during dangerous weather.
  • Party All Day Rentals cannot guarantee the safety or performance of any tent during severe weather events and assumes no responsibility for weather-related damage, injury, or loss occurring after installation.
  • The renter agrees to:
    • Keep all tent stakes, anchors, ropes, ratchets and ballast systems in their original installed positions.
    • Never remove, loosen, relocate, or tamper with any tent anchoring components.
    • Not attach decorations, lighting, signs, banners or other items to the tent unless approved by Party All Day Rentals.
    • Notify Party All Day Rentals immeditately if any part of the tent becomes loose, damaged, or unsafe.
  • Party All Day Rentals reserves the right to refuse installation if the site is determined to be unsafe due to underground hazards, inadequate space, excessive slope, poor soil conditions, weather conditions, or any circumstance that may compromise the safety of our crew, equipment, or guests.
  • If installation cannot be safely completed upon arrival due to site conditions not previously disclosed, additional charges may apply, or the installation may be canceled.
  • No open flames, fire pits, grills, propane heaters not approved by Party All Day Rentals, fireworks, sparklers, or other ignition sources may be used inside or directly adjacent to the tent unless specifically authorized.
  • Smoking inside any tent is prohibited.
  • The customer is responsible for complying with all local fire codes and venue regulations.

10. Dunk Tank Rentals

  • The renter is responsible for ensuring the dunk tank is supervised by a responsible adult at all times while it contains water. The dunk tank should never be left unattended, especially when children are present.
  • Water presents a drowning hazard, even in shallow depths. Children should never be allowed to play in, climb on, or around the dunk tank without close adult supervision.
  • Use of the dunk tank is entirely at the renter’s and participants’ own risk. By renting the dunk tank, the renter accepts full responsibility for the safe operation and supervision of the equipment throughout the rental period.
  • Party All Day Rentals shall not be liable for any injuries, accidents, illness, drowning, slips, falls, property damage, or other losses resulting from the use or misuse of the dunk tank.
  • The dunk tank is designed to be used only as intended. The renter agrees to ensure that:
    • Only one person occupies the dunk tank seat at a time.
    • Participants are physically capable of safely entering and exiting the tank.
    • No diving, jumping, climbing, horseplay, roughhousing, or standing on the tank frame is permitted.
    • Anyone who appears intoxicated or impaired should not participate.
  • The renter is responsible for maintaining a safe area around the dunk tank. Wet surfaces may become slippery during normal use.
  • The area around the dunk tank should be kept clear of obstacles, electrical equipment, extension cords, and unnecessary foot traffic to reduce the risk of slips and falls.
  • The renter is responsible for protecting the dunk tank from damage during the rental period.
  • The following are prohibited:
    • Climbing or sitting on the frame other than the designated seat.
    • Pulling, bending, or hanging from the frame.
    • Dragging or moving the dunk tank after installation.
    • Using knives, sharp objects, glass, fireworks, or open flames near the dunk tank.
    • Altering or modifying any part of the dunk tank.
  • The renter is financially responsible for any damage beyond normal wear and tear, including but not limited to:
    • Bent, broken, or damaged steel frame components.
    • Torn, punctured, cut, or damaged vinyl tank liner.
    • Damaged seat, latch, target assembly, or throwing target.
    • Missing parts or accessories, including the balls.
    • Damage caused by misuse, vandalism, negligence, unauthorized relocation, or improper transportation.
  • Repair or replacement costs may be charged based on the extent of the damage.
  • If Party All Day Rentals provides delivery and setup, the dunk tank must remain in its installed location throughout the rental period.
  • The renter shall not attempt to move the dunk tank while it contains water or after it has been installed. Unauthorized relocation may result in equipment damage and additional charges.
  • The renter is responsible for providing a suitable water source unless otherwise agreed.
  • The dunk tank should not be used during lightning, severe thunderstorms, high winds, or other dangerous weather conditions.
  • By accepting delivery or taking possession of the dunk tank, the renter acknowledges that they assume full responsibility for the supervision, operation, and safe use of the equipment during the entire rental period.
  • The renter agrees to indemnify and hold harmless Party All Day Rentals, its owners, employees, and representatives from any claims, injuries, damages, losses, liabilities, or expenses arising from the use, misuse, or operation of the dunk tank, except to the extent caused by Party All Day Rentals’ gross negligence or willful misconduct.

11. Security Deposit

  • While most of our rentals do not require a security deposit, on occasion Party All Day Rentals reserves the right to require a security deposit if there is risk to our items
  • The security deposit is fully refundable upon the return of our items and after inspection
  • The secuirty deposit will be refunded in the same payment method that was used

12. Fees & Additional Charges

Certain services and circumstances may result in additional charges. These may include, but are not limited to:

  • Delivery and pickup fees
  • Setup and takedown services
  • Extended delivery distances
  • Stair carries or long-distance carries beyond standard curbside delivery
  • Second-story or difficult access deliveries
  • Same-day or rush orders
  • After-hours deliveries or pickups
  • Additional rental days
  • Damage, loss, theft, or excessive cleaning of rental equipment
  • Waiting time caused by site delays or inaccessible delivery locations
  • Failed delivery or pickup attempts
  • Late returns
  • Setup delays caused by the site not being ready
  • Fuel surcharges or extraordinary travel costs for remote locations
  • Additional delivery vehicles for larger orders

All applicable fees will be disclosed on your quote, rental agreement, invoice, or current pricing schedule before services are performed whenever reasonably possible.

13. Use & Care of Equipment

  • The Renter assumes full responsibility for the rented items from delivery until pickup.
  • Items must be used properly and only for their intended purpose.
  • Renter agrees to keep equipment protected from damage, misuse, theft, or weather (including rain, snow, and high winds).
  • No tape, glue, markers, staples nails or decorations may be applied to rental items without written permission.

14. Weather Policy

  • For outdoor events, Renter is responsible for monitoring weather conditions.
  • Equipment must not be used during heavy rain, wind above 15 mph, lightning, or unsafe conditions.
  • The Company reserves the right to cancel or postpone delivery if conditions are unsafe.

15. Ownership

  • All rental items remain the property of Party All Day Rentals.
  • Renter may not sell, sublease, or transfer possession of any rental items.

16. Indemnification

Renter agrees to indemnify and hold harmless Party All Day Rentals, its employees, and agents from any claims, damages, or liabilities arising out of the use or possession of the rental equipment.

17. Agreement

By signing the Rental Reservation Agreement, the Renter acknowledges they have read, understood, and agree to these Terms & Conditions, Rental Policy or Reservation Agreement.
